A federal appeals court has ruled that the U.S. Bureau of Prisons can move biological male inmates who identify as transgender out of women’s prisons and into male facilities following a major policy change under the current administration. The decision impacts more than a dozen inmates who had previously been protected by a lower court order blocking the transfers. Judges determined there was not enough evidence at this stage to prove the moves amounted to unconstitutional “cruel and unusual punishment” under the Eighth Amendment, as the legal battle over transgender housing policies in federal prisons continues.
