A sitting governor just made it a felony for federal immigration agents to set foot near a ballot box in her state.
New Mexico Governor Michelle Lujan Grisham signed Senate Bill 264 into law on March 9, 2026, making her state the first in the nation to specifically ban armed federal agents, including Immigration and Customs Enforcement officers, from polling places, parking areas, and within 50 feet of any official ballot drop box. The restrictions take effect 28 days before Election Day when early voting begins, and violations are classified as felonies. The legislation passed the New Mexico Senate 26 to 16 and the House 41 to 26, with every Democrat voting in favor and every Republican voting against. The law was filed the day after President Trump publicly suggested nationalizing certain election processes. Federal law already restricts the deployment of military troops to polling locations, but New Mexico’s measure extends that prohibition to armed federal personnel of any kind. Similar bills are now under consideration in California, Kansas, Virginia, and Washington.
A government willing to criminalize the presence of its own federal officers near a voting booth has revealed how it views the integrity of the people walking up to that booth. Voters who follow the law have nothing to fear from law enforcement standing nearby. Those who do not are now protected by a felony statute.
